These terms

We are X360 Growth, based at 2209 Falcon Ave, Bettendorf, IA 52722, and we provide X360 Growth and Max. By starting a plan or using X360 Growth you agree to these terms on behalf of yourself and your business. You must be 18 or over.

What you get

X360 Growth is a complete system to run your business: customers, booking, messages, invoices, forms, reviews, social media and your website, with Max, the assistant that does the work when you ask. What each plan includes is described on our Pricing page. We keep improving X360 Growth, so features may change. If we remove something important to your plan, we will tell you first.

Price and billing

• Your plan: billed monthly in US dollars, starting the day you sign up and then on the same date each month, until you cancel.
• Special promotion: if you joined at the $147 a month promotion, that price is locked in for as long as your plan stays active, even if our regular price changes.
• Price changes: for any other price change, we will email you at least 30 days before your next charge at the new price, so you can cancel first.
• Setup: free. White-Glove Setup, where we set things up for you, is optional and quoted before you agree to it.
• Messaging: your phone number and texting registration are included. Texts, calls and emails are paid for from a messaging balance that starts at $25 and tops up by $25 when it drops below $10. Rates are shown in your account.
• AI allowance: each plan includes a set amount of AI use each month. It is not unlimited. If you reach it, some of Max's work pauses until the next month.

No contract. Cancel any time.

You can cancel whenever you like. Email admin@x360growth.com or call (563) 940-1299 and we will do it for you. Cancelling stops all future charges, and you keep access until the end of the month you have already paid for. We do not refund part months. Unused messaging balance is not refunded. After you cancel we keep your account and website for 90 days so you can come back or ask for a copy of your information, and then delete it.

Max does the work you approve

Max is an assistant that uses artificial intelligence. It is not a person. Max shows you a plan before it changes anything, and nothing happens until you tap Approve. Sending to your clients, posting in public, deleting and anything to do with money need a second yes. Please read what Max proposes before you approve it: you are responsible for the changes you approve. Max can make mistakes, so check anything important, such as prices, dates and anything you publish.

What you look after

• Your information and your clients' information belong to your business. You give us permission to store and process it to run X360 Growth for you.
• Consent to message people. Only text, call or email people who have agreed to hear from you, and honor opt-outs. You are responsible for following texting and email laws, including the Telephone Consumer Protection Act, CAN-SPAM and carrier rules.
• What you publish on your website, social media and messages, including that it is true and that you have the right to use it.
• Your sign in. Keep access to your email private, and only give access to people you trust to act for your business.
• Health information. X360 Growth is not set up for HIPAA. If your business is a HIPAA covered entity, do not store protected health information in it.

What is not allowed

Do not use X360 Growth to send spam, to message people who have not agreed to it, for anything illegal, harmful or deceptive (including fake reviews), to sell regulated products without the licenses they need, or to try to break, overload or get around the security of the service. We may suspend an account that does, and we will tell you why.

Your website and web address

Your website is hosted by X360 Growth while your plan is active. If you use your own web address, you keep ownership of it and of your domain account. If you cancel, point your web address elsewhere and we will remove it from our hosting.

Our service

We work to keep X360 Growth running and your information safe, but we cannot promise it will never be interrupted or free of errors. X360 Growth relies on outside providers for messaging, payments, AI and hosting. X360 Growth, Max and our website, software and designs belong to us. You may use them to run your business while your plan is active.

Results

Every business is different. X360 Growth is built to save you time and help you grow, but we cannot promise a particular amount of time saved, revenue or any other result.

Limits on our liability

To the extent the law allows, X360 Growth is not liable for indirect or consequential losses, such as lost profits or lost data, and our total liability for any claim is limited to the fees you paid us in the three months before the claim. Nothing in these terms limits any liability that cannot lawfully be limited.

Changes to these terms

We may update these terms. The version on this page applies, and the date at the top shows when it last changed. If a change materially affects your plan, we will email you before it takes effect.

The law that applies

These terms are governed by the law of the State of Iowa.
